How we approach these matters

Frequently asked questions
What does the Appellate Tribunal for Electricity (APTEL) hear?
Under Section 111 of the Electricity Act, 2003, APTEL hears appeals against orders of the Central Electricity Regulatory Commission and State Electricity Regulatory Commissions, and of adjudicating officers under the Act. APTEL sits in New Delhi.
How do I appeal against an APTEL order?
Section 125 of the Electricity Act, 2003 provides for an appeal to the Supreme Court within 60 days of communication of the APTEL decision, on the grounds specified in Section 100 of the Code of Civil Procedure — in effect, a substantial question of law. The Supreme Court may allow a further period of up to 60 days for sufficient cause.
What disputes does CERC decide?
Under Section 79 of the Electricity Act, 2003, CERC regulates the tariff of generating companies owned or controlled by the Central Government, inter-state generation and transmission of electricity, and adjudicates disputes involving them, among other functions. State Commissions perform corresponding functions within each state.
