How we approach these matters
Real estate disputes frequently have several available forums — RERA, consumer commissions, civil courts, arbitration and writ courts. Choosing correctly at the outset saves years. We advise homebuyers, landowners, developers and contractors on the forum and remedy best suited to their objective.

Frequently asked questions
Can I approach RERA if my builder has delayed possession?
Yes. An allottee may file a complaint before the State Real Estate Regulatory Authority under Section 31 of the Real Estate (Regulation and Development) Act, 2016. Under Section 18, where possession is delayed, the allottee may seek a refund with interest or, if they wish to remain in the project, interest for every month of delay.
Should I go to RERA or the Consumer Commission?
Both may be available. The Supreme Court held in Imperia Structures Ltd. v. Anil Patni (2020) that the remedies under RERA and the Consumer Protection Act are concurrent, so a homebuyer may choose. The better forum depends on the relief sought, the amount involved and practical considerations such as timelines.
How are RERA orders appealed?
An appeal against an order of the Authority lies to the Real Estate Appellate Tribunal under Section 44 of RERA within 60 days, and a further appeal against the Tribunal's order lies to the High Court under Section 58 within 60 days.
