Regulatory & Appellate Litigation

Proceedings before sectoral regulators and appellate tribunals, and onward appeals to the High Courts and Supreme Court.

Regulators · Appellate Tribunals · Statutory Appeals

Regulatory disputes frequently require simultaneous understanding of the underlying sector, statutory framework and appellate mechanism.

Dixit & Dixit represents clients in complex regulatory and appellate proceedings.

Our work involves

  • Sectoral regulation
  • Regulatory authorities
  • Statutory appeals
  • Regulatory investigations
  • Regulatory compliance
  • Government decisions
  • Infrastructure regulation
  • Energy regulation
  • Environmental regulation
  • Real estate regulation
  • Commercial regulation

How we approach these matters

Regulatory litigation is technical and record-driven. Tribunals decide on the material placed before the regulator, and appellate courts are reluctant to look beyond it. We therefore treat proceedings before the regulator as the foundation of any eventual appeal — building a complete technical and legal record from the start.

Frequently asked questions

Can a regulator's order be challenged directly in the Supreme Court?

It depends on the statute. Many regulatory statutes provide an appeal first to a specialised appellate tribunal and then a statutory appeal to the Supreme Court — for example, appeals from APTEL under Section 125 of the Electricity Act, 2003, and from the NGT under Section 22 of the National Green Tribunal Act, 2010. Others provide for an appeal to the High Court. The correct route and its time limit must be identified at once.

What is a "statutory appeal"?

A statutory appeal is an appeal that a specific Act provides as of right, usually on defined grounds and within a fixed limitation period. Unlike a Special Leave Petition, the appellate court does not first decide whether to grant leave, although some statutes limit appeals to questions of law.
