Frequently asked questions

How do I challenge a GST demand order?

An appeal against an adjudication order ordinarily lies to the Appellate Authority under Section 107 of the CGST Act, 2017, within three months, and thereafter to the GST Appellate Tribunal (GSTAT) under Section 112. The GSTAT is now operational, with a Principal Bench in New Delhi, State Benches and e-filing of appeals. Pre-deposit requirements apply. In appropriate cases — for example, where an order is without jurisdiction or passed in breach of natural justice — a writ petition before the High Court may be considered.

Can I go directly to the High Court against a tax notice?

High Courts generally expect the statutory appeal to be pursued, but they may entertain a writ petition where there is a lack of jurisdiction, a violation of natural justice, or a challenge to the validity of a provision. Whether a writ is appropriate depends on the facts.
